Corss-border successions (the decesed was a foreign national, a Romanian national domiciled abroad, inheritors are foreign nationals)
In the case of an inheritance, where the assets are located in Romania competence lies, in general, with the Romanian notary.
A certificate of succession is required in order to prove the quality of inheritor and ownership over the inherited assets to all competent authorities, in order to be able to withdraw money from bank accounts, or rent or sell the inherited assets, etc.
Starting from 2015, in order to solve cross-border successions, a European Certificate of Succession will start circulating in EU member states. This certificate shall be issued by the notary in a special procedure and will need no further formalities in order to be used in any of the member states. (see the text of the Regulation )
The field of international successions is a complicated one and requires specialized information in order to shorten the duration of the procedure that can often be difficult due to the placement of the inheritors, assets or authorities in different states, and to the need to know and follow the national legisltation of several different countries.
